Terms and conditions
1.1These definitions and rules of interpretation apply in these Terms:
Box Office: any Llangollen Fringe Festival box office currently in existence.
Contract: any contract between Llangollen Fringe Festival and You for the sale and purchase of a Ticket.
Event: an arts and music Event organised by Llangollen Fringe Festival in relation to which a Ticket is purchased
Llangollen Fringe Festival: A Company whose Registered Office is at
Order: any order which You submit to Llangollen Fringe Festival, requesting a Ticket, whether in writing or by telephone or online booking.
Site: the site at which a relevant Event is staged.
Terms: the terms and conditions set out in this document.
Ticket: any ticket, which Llangollen Fringe Festival agrees to supply to You for entry to an Event.
You: a person, firm, company or unincorporated entity who or which purchases a Ticket from Llangollen Fringe Festival.
1.2. A reference to a law is a reference to it as it is in force for the time being taking account of any amendment, extension, application or re-enactment and includes any subordinate legislation for the time being in force made under it.
1. 3 Words in the singular include the plural and in the plural include the singular.
1. 4 Term headings do not affect the interpretation of these Terms.
- Application of the Terms
2.1 The Contract shall be on these Terms to the exclusion of all other terms and conditions (including any terms or conditions which You purport to apply under any Order, confirmation of order, specification or other document or communication).
2.2 No terms or conditions endorsed on, delivered with or contained in other document or communication shall form part of the Contract.
2.3 These Terms shall apply to all Llangollen Fringe Festival’s sales of Tickets and any variation to these Terms and any representations about any Ticket or any Event to which such a Ticket may relate shall have no effect unless expressly agreed in writing and validly signed for and on behalf of Llangollen Fringe Festival.
2.4 These Terms do not affect your statutory rights.
2.5 Llangollen Fringe Festival may from time to time publish on its website further terms and conditions in relation to the sale of Tickets in addition to these Terms. Such further terms and conditions shall be deemed to be included in these Terms and be incorporated into the Contract. If and to the extent that there is any conflict between such further terms and these Terms, the further terms shall prevail.
2.6 You acknowledge that You have not relied on any statement, promise or representation made or given by or on behalf of Llangollen Fringe Festival which is not set out in these Terms.
2.7 Each Order for a Ticket by You from Llangollen Fringe Festival shall be deemed to be an offer by You to buy that Ticket or those Tickets stated in the Order and made subject to these Terms.
2.8 No Order shall be deemed to be accepted by Llangollen Fringe Festival until we have confirmed your Order in writing.
2.9 If You breach any of these Terms, Llangollen Fringe Festival shall be entitled to cancel any or all Tickets bought by You.
2.10 If Llangollen Fringe Festival cancels any Ticket pursuant to Term 2.9, we shall not be obliged to repay to You any amount which it has received from You in respect of that Ticket.
3.1 Unless otherwise agreed by Llangollen Fringe Festival in writing, the price for Tickets shall be the price set out on Llangollen Fringe Festival’s website in respect of Tickets for the relevant Event on the date on which you place your Order for the relevant Ticket.
3.2 You shall send payment price for the Ticket at the same time that You submit the Order for that Ticket.
3.3 No payment shall be deemed to have been received in respect of a Ticket until Llangollen Fringe Festival has received that money in cleared funds.
3.4 You shall not have the benefit of any Ticket, or of any rights of entry to any Event to which a Ticket relates until Llangollen Fringe Festival has received in full (in cash or cleared funds) all sums due to it under the relevant Contract.
4.1 If you have purchased Tickets through the website then upon receipt of your Order and payment, you will be sent an email to confirm your Ticket purchase (Confirmation Email). Your Confirmation Email will provide instructions on how to collect your Ticket.
4.2 All Tickets can be collected from the Box Office prior to, or on the day of the Event. Please see the Website for Box Office opening hours. Your Confirmation Email must be provided upon collection of the Tickets.
4.3 If for any reason You fail to collect any Ticket, the Ticket shall nevertheless be deemed to have been delivered as provided in Term 4.4.
4.4 Unless otherwise agreed in writing by Llangollen Fringe Festival, delivery shall be deemed to have taken place on the date on which Llangollen Fringe Festival sends the Confirmation Email to You.
5. Tickets and Events
5.1 Whilst the Llangollen Fringe Festival will use reasonable endeavours to verify the accuracy of any information we publish at the time of publication, we make no warranties, whether express or implied, in relation to its accuracy.
5.2 Llangollen Fringe Festival reserves the right to rearrange, cancel or postpone any Event previously scheduled to occur, if it reasonably decides that it needs to do so as a result of the occurrence of any matter or circumstance beyond Llangollen Fringe Festival’s reasonable control.
5.3 If Llangollen Fringe Festival exercises its right stated in Term 5.2, it shall not be obliged to repay You any money that You have paid to it in respect of a Ticket.
5.4 You may not resell any Ticket to any person or unincorporated entity for any reason or on any basis whatsoever. This restriction shall not apply to any decision by Llangollen Fringe Festival to refund the price of any Ticket to you, in return for your Ticket.
5.5 Llangollen Fringe Festival will not be held responsible for any Tickets lost, misplaced, stolen or lost in transit. No Tickets will be reissued at the expense of Llangollen Fringe Festival.
- Cancellation and Refunds
6.1 The United Kingdom’s Distance Selling Regulations apply to Orders made on-line, or by telephone. You therefore may cancel any contract for the purchase of any Tickets made on-line within seven working days of receiving the Confirmation Email by providing written notice. Thereafter, subject to any other term of the relevant Contract, Llangollen Fringe Festival shall not be obliged to refund the ticket price for the relevant refund.
6.2 You will not be able to cancel your Order once Llangollen Fringe Festival has started to provide You with the service.
6.3 Llangollen Fringe Festival will not make any refund in respect of any lost, stolen or damaged Tickets.
6.4 Llangollen Fringe Festival may (acting reasonably) refuse any person admission to any Event. Llangollen Fringe will not offer any refund to any person who has bought a Ticket and who is refused entry.
6.5 Llangollen Fringe Festival may at its option and at its absolute discretion amend any element of, or cancel any Event.
6.6 If Llangollen Fringe Festival cancels an Event prior to commencement of the relevant Event other than in accordance with Term 5.2, Llangollen Fringe Festival agrees that it will refund the purchase price of any Ticket purchased for access to that Event less a 10% administration fee.
6.7 It is your responsibility to check whether the Event in respect of which You have bought a Ticket is to take place on the date and at the time and venue previously notified in relation to that Event. Llangollen Fringe Festival does not warrant that it will be able to contact You in respect of the cancellation of, or any change to any Event. This is particularly the case if any such change is made at short notice before the start of the relevant Event.
- Limitation of liability
7.1 Subject to Term 7.2:
i. if Llangollen Fringe Festival is in breach of any of the terms of any Contract, it will not be responsible for any losses that You suffer as a result of the breach, except those losses which are a foreseeable consequence of the relevant breach; and
ii. Llangollen Fringe Festival’s liability shall not in any event include any losses:
(a) related to any business in connection with which You may be involved, such as (without limitation) lost data, lost profits or loss arising from business interruption;
(b) arising from your purchase of any goods or services supplied to you by any third party; or
(c) arising from the actions of any person in respect of whom Llangollen Fringe Festival does not bear a legal responsibility.
7.2 Nothing in these Terms excludes or limits the liability of Llangollen Fringe Festival:
i. for death or personal injury caused by Llangollen Fringe Festival’s negligence;
ii. under section 2(3), Consumer Protection Act 1987;
iii. for fraud or fraudulent misrepresentation; or
iv. for any matter which it would be illegal for Llangollen Fringe Festival to exclude or attempt to exclude its liability.
- Site Information and Regulations
8.1 You consent to being – deliberately or inadvertently – photographed, filmed and/or sound recorded for TV, Video, DVD, Webcast or other broadcast as part of the audience or by security CCTV, and you give permission for Llangollen Fringe Festival to use that material.
8.2 Llangollen Fringe Festival will not allow any person below the age of 16 years of age to enter or be present on the Site unless accompanied and at all times effectively supervised by an appropriate number of suitable adults aged over the age of 18.
8.3 You will at all times that You are on the Site act in such as way as not to prejudice the security of the Site or any part of it or the safety of any other person on the Site or the smooth-running of the Event.
8.4 Alcoholic drinks and open bottles/cans of soft drinks are not permitted to be taken in to Events held at the Town Hall Site.
8.5 Alcohol is for sale to those over 18 years old in publicised areas at some sites. Llangollen Fringe Festival considers that incompetence through the consumption of alcohol constitutes anti-social behaviour. Llangollen Fringe Festival reserves the right to eject from Site any person whom it reasonably considers to be causing a nuisance to any other person and is intoxicated.
8.6 Be aware that strobe lighting may be used at some Events.

9.1 Llangollen Fringe Festival is a Company in England and Wales (Company number 03688872) of Sunnydale, Abbey Road, Llangollen, Denbighshire, LL20 8SS.
- How Llangollen Fringe Festival may use your information
We may use the personal information you provide to us to:
(a) provide the Goods and/or Services;
(b) process your payment for such Goods and/or Services; and
- Other important terms
11.1 Llangollen Fringe Festival may transfer our rights and obligations under these Terms to another organisation, and we will always notify you in writing if this happens, but this will not affect your rights.
11.2 Each or these provisions operates separately. If any provision or part-provision of the Contract is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of the Contract.
11.3 A person who is not a party to the Contract shall not have any rights to enforce its provisions.
11.4 These Terms are governed and construed in accordance with the law of England and Wales. You and Llangollen Fringe Festival both agree to submit to the exclusive jurisdiction of the English and Welsh courts.
Llangollen Fringe ("We") are committed to protecting and respecting your privacy.
For the purpose of the Data Protection Act 1998 (the Act), the data controller is Llangollen Fringe ( Organisation number 03688872) of Sunnydale, Abbey Road, Llangollen, Denbighshire, LL20 8SS.
Information we may collect from you
We may collect and process the following data about you:
Information you give us. You may give us information about you by filling in forms on our site www.llangollenfringe.co.uk (our site) or by corresponding with us by phone, e-mail or otherwise. - Analytics and search engine providers that assist us in the improvement and optimisation of our site.

- In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
- If the Llangollen Fringe or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.

The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.
